On Wednesday, Vilnius Regional Court did not satisfy AB Mazeikiu Nafta’s request regarding application of interim measures, as well as AB Lietuvos Gelezinkeliai’s Request to secure compensation of losses. The Court indicated (inter alia) that there was no threat that Lietuvos Gelezinkeliai would not transport Mazeikiu Nafta’s products and that interim measures would not perform their function.

This court decision does not preclude Mazeikiu Nafta from presenting the claim to acknowledge the termination of the agreement as not legitimate and to claim for recalculation of the tariffs and compensation of losses, including, but not limited to, the period from September 1, 2008.

The two companies, long-term partners, differently interpret the agreement with Lietuvos Gelezinkeliai effective since 1999. From September, Lietuvos Gelezinkeliai unilaterally terminated the agreement with Mazeikiu Nafta for application of reduced tariffs.
